The Terms and Conditions contained herein shall apply to any person (“User”) for making payments through the online payment gateway service offered by PhonePe, through Rotary Club of Bombay website, that is, https://www.rotaryclubofbombay.org for donations. Each User is deemed to have read and accepted these Terms and Conditions.
Any information gathered through these Terms and Conditions shall be subject to our Privacy Policy which is incorporated herein by reference and available at https://rotaryclubofbombay.org/privacy-policy.html. If you do not agree to be bound or cannot comply with any of the Terms and Conditions or the Privacy Policy, please do not continue with the Donation towards the Campaign. Your act of making the Donation shall be deemed as your unconditional agreement and acceptance of the Terms and Conditions and the Privacy Policy.
This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
Principle Rules
The Donations towards any cause shall be made to the Rotary Club Bombay Charities Trust No. 3.
Eligibility
You are eligible to make a donation if (i) you have attained the age of majority i.e. eighteen (18) years or (ii) you are a company/proprietorship or any other entity duly registered/incorporated under the laws of India.
Payment through online transfer can be made on this website (www.rotaryclubofbombay.org) and following the instructions therein to make the donations upon which the Donor shall be redirected to the payment gateway to complete the Donation transaction. The Donations received through this payment mechanism shall be directly deposited into the ROTARY CLUB BOMBAY CHARITIES TRUST NO. 3’s account.
The Donor shall also be bound by the terms and conditions of the payment gateway service provider while making donations.
For purposes of these Terms and Conditions, “receipt/processing” of a donation occurs when the Bank Website server records the Donation information upon the Donor clicking the “Donate/Submit/Process” button.
Kindly avoid donations of less than Rs.100/- as the processing costs make it unviable for us.
Personal Information
Your donation may result in sharing of your personal information including but not limited to your Name, Phone Number/Email ID, PAN, Credit, and/or Debit Card. (Read Rotary Club of Bombay Privacy Policy here)
Indian Nationality Donor also understands and agrees that the personal or sensitive personal information provided by the Indian Nationality Donor on such third-party websites shall be subject to the terms of such third-party websites and shall not be liable for the same.
Tax Deduction Benefit:
A Donation is eligible for tax deduction benefits under Section 80 G of the Indian Income Tax Act, 1961 if the Donor is (i) above the age of eighteen (18) years and (ii) a resident of India (as per the Income Tax Act, 1961).
Rotary Club Bombay Charities Trust No. 3 has a valid and subsisting registration under Section 80G of the Indian Income Tax Act, 1961.
Rotary Club Bombay Charities Trust No. 3 is a registered Charitable Trust in Mumbai, Maharashtra (Reg # E-7568(Bom))
Cancellation and Refund Policy
We take the utmost care to process donations as per the instructions given by our donors, online and offline. However, in case of an unlikely event of an erroneous donation, we will respond to the donor within 18 working days of receiving a valid request for a refund from the donor.
The timely refund of the donation will depend upon the type of credit card/banking instrument used during the transaction. The donor will have to send us a written request for a refund within 2 days of making the donation along with-
(i) Proof of the deduction of the donation amount.
(ii) In cases where the donation receipt has already been issued to the donor, the donor will have to return the original receipt to us at our office address.
(iii) If the tax exemption certificate is already issued, we will not be able to refund the donation. However, in case of a valid refund request due to an error on our part, we will refund the donation and bear the costs of the same.
If the donor doesn’t write within two days, then a refund is not possible.
Amendments to the Terms and Conditions
Rotary Club of Bombay reserves the right to change these terms and conditions at any time and without prior notice by posting changes online. Please check back from time to time so you are aware of any changes or updates to the Terms and Conditions. You may reach out to us if you have any queries about any changes made to our practices.
We understand your concerns about safety and security and assure you that we make every effort to safeguard your privacy when you make donations through our system.
Payment Gateway
In case the website or payment service provider’s web page (that is linked to TSS Website) is experiencing any server-related issues like ‘slow down or ‘failure’ or ‘session time-out, the User shall, before initiating the second payment attempt, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:
In case the Bank Account appears to be debited, ensure that he/she does not make the payment twice and immediately thereafter contact his/her bank via email or other modes of contact as provided by him to confirm the payment.
In case the Bank Account is not debited, the User may initiate a fresh transaction to make a payment. However, the User agrees that under no circumstances Rotary Club of Bombay and / or Rotary Club Bombay Charities Trust No. 3 shall be held responsible for such fraudulent/duplicate transactions, and hence no claims should be raised.
Neither Rotary Club of Bombay nor Rotary Club Charities Trust No. 3 shall be liable for any inaccuracy, error, or delay in, or omission of any data or message, or the transmission or delivery of any such data, information, or message or any loss or damage arising from or occasioned by any such inaccuracy, error, delay or omission, non-performance or interruption in any such data, information or message.
The User also agrees, understands, and confirms that his/her personal data including without limitation details relating to debit cards/credit cards/net banking transmitted over the internet may be susceptible to misuse, hacking, theft, and/or fraud and that Rotary Club of Bombay / Rotary Club Bombay Charites Trust No. 3 or its team has no control over such matters.
Debit / Credit Card, Bank Account Details
The User agrees that the debit/credit card details provided by him/her for use of the aforesaid service(s) must be correct and accurate and that the User shall not use a debit/credit card that is not lawfully owned by him/her of which is not authorized by the lawful owner thereof. The user further agrees and undertakes to provide a correct and valid debit/credit card details.
The User may make payment for donation using a debit/credit card or through an online banking account. The user warrants to agree and confirm that when he/she initiates a payment transaction and/or issues an online payment instruction and provides his/her details:
The user is fully and lawfully entitled to use such credit/debit card or bank account for such transactions.
The User is responsible to ensure sufficient credit is available on the nominated card/bank account at the time of making payment to permit the payment of the dues payable or the bill(s) selected by the used inclusive of the applicable charges.
Security
All payment details which are entered through this payment gateway are encrypted when the User, or third party making payment, enters them. Communications to and from the Service Provider’s site are encrypted. Rotary Club of Bombay / Rotary Club Bombay Charities Trust No. 3 shall not be liable for any failure by the User or third party making payment to properly protect data from being seen on their screen by other persons or otherwise obtained by such persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.
